Date: Mon, 27 Feb 1989 12:20:00 -0500 1996-205 Curry Brandaw Architects ORDINANCE NO. 10484 AN ORDINANCE CLOSING AND ABANDONING UNNAMED STREETS LOCATED NORTHEAST FROM SHALLOWFORD ROAD, NORTHWEST OF ASHFORD DRIVE, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned unnamed streets located northeast from Shallowford Road, northwest of Ashford Drive, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Two unnamed 40 foot wide unopened rights-of-way, the first beginning on the northeast line of Shallowford Road 476.45 feet northwest of the intersection of the northeast line of Shallowford Road with the northeast line of Ashford Drive, and extending northeast 1298.6 feet between parallel lines to the southwest line of McCutcheon Road (abandoned by City of Chattanooga Ordinance No. 8405). Said street separates blocks 23 and 26 from blocks 24 and 25, Brookshire Subdivision, as shown by plat of record in plat book 12, page 39, ROHC. The second unnamed 40 foot wide unopened right-of-way begins on the northwest line of the above described right-of-way 600 feet northeast of the intersection of the northwest line of the first right-of-way with the northeast line of Shallowford Road, and extends northwest 300 feet between parallel lines to the southeast line of another unnamed 40 foot wide unopened right-of-way. The second street to be abandoned separates lot 6, block 23, from lot 1, block 26, said Brookshire Subdivision. Tax Map No. 149G-B-8 and 9. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The City of Chattanooga has a sewer line crossing the right-of-way and reserves an easement 10 feet each side of the sewer line for the purpose of maintaining said sewer. 2. The areas reserved for utility easements must be kept free and clear of all structures. 3. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
